Terms & Conditions

By accessing, registering on, or using the FittMeter platform — including the mobile application (Android/iOS) and web portal — you confirm that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree to these terms, you must not use our services.

• You are at least 18 years of age (or 13+ with verified parental consent for member accounts)
• You have the legal capacity to enter into a binding agreement
• You will comply with all applicable Indian laws and regulations
• These terms form a legally binding agreement between you and FittMeter Technologies Pvt. Ltd.

• You are solely responsible for maintaining the confidentiality of your login credentials (email, password, OTP codes)
• You must not share your account with any other person or allow unauthorised access
• You agree to provide accurate, current, and complete information during registration and to update it as needed
• FittMeter reserves the right to suspend or permanently terminate accounts that violate these Terms, engage in fraud, or misuse the platform
• You are responsible for all activities that occur under your account
• Notify us immediately at security@fittmeter.com if you suspect unauthorised access to your account

• Gym Owners must provide accurate gym details including name, address, operating hours, and contact information
• You are responsible for the accuracy of membership fee structures and plan details listed on the platform
• You must obtain all necessary licences, certifications, and regulatory approvals to operate a fitness centre in your jurisdiction
• Gym Owners must not list a gym that is not operational or does not have a physical presence
• Member data accessed through FittMeter (attendance, payments, personal details) must be used solely for gym management purposes and must not be shared with third parties
• Attendance records, once confirmed, should not be retroactively modified without legitimate cause
• FittMeter reserves the right to remove or suspend gym listings that receive repeated complaints or violate platform standards

• All product listings must be accurate, complete, and not misleading. False product descriptions are grounds for immediate removal
• Sellers are responsible for maintaining accurate inventory levels and fulfilling orders within the stated dispatch window
• All listed products must comply with applicable FSSAI, BIS, and consumer protection regulations
• Counterfeit, illegal, prohibited, or hazardous products are strictly forbidden and will result in permanent account termination
• Sellers must comply with all applicable GST, TDS, and income tax obligations independently
• FittMeter is not responsible for disputes between sellers and buyers arising from product quality, delivery delays, or return disputes
• Sellers must honour their stated return/refund policy for every order

• FittMeter charges a platform commission on store sales (typically 5–15%, disclosed at onboarding)
• FittMeter charges a platform subscription fee from Gym Owners for access to the management dashboard
• Payouts to Gym Owners and Sellers are processed on a defined payout cycle (typically monthly) minus applicable commissions
• For cash payments collected by gym owners on behalf of the platform, owners must remit the platform's share within the agreed settlement period
• FittMeter reserves the right to withhold payouts in cases of suspected fraud, chargebacks, or policy violations pending investigation

All content, design, software, trademarks, logos, and intellectual property on the FittMeter platform — including the mobile app, web portal, marketing materials, and documentation — are owned by FittMeter Technologies Pvt. Ltd. or its licensors.

• You may not copy, reproduce, distribute, or create derivative works of any FittMeter content without written permission
• The FittMeter name, logo, and taglines are registered trademarks. Unauthorised use is strictly prohibited
• User-generated content (reviews, photos, product listings) remains your property; by submitting it, you grant FittMeter a non-exclusive, royalty-free licence to display it on the platform

The following activities are strictly prohibited on the FittMeter platform:

• Using the platform for any unlawful, fraudulent, or deceptive purpose
• Uploading false, misleading, or fraudulent product listings or gym information
• Attempting to reverse-engineer, decompile, hack, or compromise platform security
• Creating fake accounts, fake reviews, or fake attendance records
• Scraping, crawling, or collecting user data without authorisation
• Circumventing platform fees or commission structures
• Harassing, threatening, or abusing other users or FittMeter staff
• Uploading content that is defamatory, obscene, hateful, or infringes third-party rights

To the maximum extent permitted by applicable law, FittMeter Technologies Pvt. Ltd. shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform
• Loss of revenue, profits, data, or business opportunities
• Physical injuries or health issues arising from gym activities facilitated through the platform
• Actions or omissions of third-party service providers (Razorpay, Shiprocket, gym owners, sellers)
• Platform downtime, data loss, or service interruptions due to force majeure events

FittMeter may suspend or terminate your account immediately, without prior notice, if you:

• Violate any provision of these Terms & Conditions
• Engage in fraudulent, abusive, or illegal activity
• Fail to remit cash commissions or platform fees on time (Gym Owners/Sellers)
• Receive repeated substantiated complaints from members or customers

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the competent courts located in India. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
